VAWA
- VAWA (Violence Against Women Act) Benefits: Provides victims of domestic abuse by citizens or legal residents the opportunity to apply for legal status without the abuser’s sponsorship. Allows to live and work in the U.S. independently and eventually obtain permanent residency.
- Requirements for VAWA:
- Be a victim of physical or emotional abuse by a citizen or resident spouse, parent, or child.
- Demonstrate a bona fide family relationship (e.g., lawful marriage).
- Have lived with the abuser and demonstrate good moral character.
- Process for Obtaining Status under VAWA:
- File Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, with proof of abuse and relationship to abuser.
- If approved, apply for adjustment of status with Form I-485 to obtain permanent residence.
- Attend an interview to confirm details and approve residency.
