Am I eligible for a T Visa?
You may qualify if you were forced into labor or other exploitation in the U.S., are willing to help investigators when safe to do so, and would face extreme hardship if removed.
Will applying put me at risk of deportation?
No. Once your petition is filed, USCIS will not deport you while it is pending, and approval grants lawful status for four years with options to extend.
How long does the T Visa process take?
Current cases range from about 12 to 36 months, depending on workload and the complexity of evidence.
Can I include my spouse or children?
Yes. Approved T-1 holders may apply for derivative visas for spouses, children and, in some cases, parents or unmarried siblings under 18.
Will I be allowed to work?
Approval automatically authorizes employment; while your case is pending you can request an interim work permit (Form I-765).
How much does it cost, and can I get a fee waiver?
USCIS filing fees for the main form are currently $0, and many related forms qualify for a full fee waiver with Form I-912 if you cannot afford them
Can a T Visa lead to a Green Card?
Yes. After three years in T status (or when the investigation ends, whichever is sooner) you may apply for a Green Card if you meet the other requirements.
