K-4 Visa

  • Benefits of the K-4 Visa:

    • The K-4 Visa allows unmarried children under the age of 21 of a K-1 Visa beneficiary to enter the U.S. along with their parent to join the U.S. citizen. It facilitates early entry for the children, avoiding family separation and allowing them to remain lawfully in the country while the parent applies for adjustment of status.
  • K-4 Visa Requirements:

    • The principal petitioner must have an approved K-1 Visa.
    • The children must be under 21 years of age and not married.
    • The children must be legally recognized as descendants of the K-1 Visa beneficiary (proof of biological relationship or legal adoption).
  • Process for Obtaining the K-4 Visa:

    • The U.S. citizen files Form I-129F, including the names of eligible children on the application.
    • Upon approval, the case is transferred to the U.S. embassy or consulate where the K-1 Visa beneficiary and his/her children will attend the interview.
    • If approved, the children receive the K-4 Visa to enter the US.
    • After the parents’ marriage within 90 days, the children may apply for adjustment of status to become permanent residents (Green Card).
