K-1 Visa
Benefits of the K-1 Visa:
- The K-1 Visa allows U.S. citizens to bring their foreign fiancé(e) to the U.S. with the intent to marry within 90 days of arrival. After the marriage, the beneficiary may apply for adjustment of status to become a permanent resident (Green Card). This is a faster process than other family-based visas and allows for early entry of the fiancé(e) to settle prior to marriage.
K-1 Visa Requirements:
- The petitioner must be a U.S. citizen.
- The fiancé(e) must have met in person at least once in the two years preceding the filing of the petition (there may be exceptions in cases of extreme hardship or cultural customs).
- There must be a legitimate intention to marry within 90 days of entry into the U.S.
- Evidence of a genuine and continuing relationship, including communication, visits and other exchanges.
Process for Obtaining the K-1 Visa:
- File Form I-129F, Petition for Alien Fiancé(e), with evidence of relationship and compliance with requirements.
- Upon approval, the case is transferred to the appropriate U.S. embassy or consulate for an interview.
- The fiancé(e) attends the interview and, if approved, receives the K-1 Visa to enter the US.
- Once in the U.S., the couple must be married within 90 days. Then, Form I-485 is filed for adjustment of status to permanent resident.
